Welcome to Second Spotlight.

These Terms of Service ("Terms") govern your use of https://www.secondspotlight.co.uk and any related services provided by Second Spotlight ("we", "our", "us").

By accessing or using Second Spotlight, you agree to these Terms.

If you do not agree to these Terms, please do not use the platform.

1. About Second Spotlight

Second Spotlight is an online marketplace that allows users to buy and sell pre-loved dancewear, costumes, shoes and related items.

We provide the platform that connects buyers and sellers. We are not the owner or seller of items listed by users unless explicitly stated otherwise.

2. Eligibility

You must be at least 18 years old to create an account, buy items, sell items or use the platform.

By using Second Spotlight, you confirm that:

  • you are legally able to enter into binding contracts
  • the information you provide is accurate and up to date
  • you will comply with these Terms and applicable laws

3. User Accounts

You are responsible for maintaining the security of your account and password.

You are responsible for all activity carried out through your account.

We reserve the right to suspend or remove accounts where:

  • these Terms are breached
  • fraudulent activity is suspected
  • abusive behaviour occurs
  • listings are misleading or inappropriate
  • users attempt to avoid marketplace fees

4. Listings and Seller Responsibilities

Sellers are responsible for ensuring that:

  • listings are accurate and truthful
  • photos represent the item fairly
  • item descriptions, sizing and condition are correct to the best of their knowledge
  • they have the legal right to sell the item
  • items comply with applicable laws and regulations

Sellers must not list:

  • counterfeit items
  • stolen goods
  • prohibited or illegal items
  • misleading or deceptive listings

Sellers are responsible for setting:

  • item prices
  • shipping costs
  • shipping methods

We recommend using tracked or signed-for delivery where possible.

5. Commission and Fees

Second Spotlight charges sellers a commission fee on completed sales.

Unless otherwise agreed in writing, the standard seller commission is 10% of the final item sale price.

Applicable payment processing fees may also apply.

By listing items on the platform, sellers authorise Second Spotlight and its payment providers to deduct applicable commission and fees before payout.

We reserve the right to change fees or commission rates in the future. Any changes will be communicated in advance where appropriate.

6. Payments and Payouts

Payments are processed securely through third-party payment providers such as Stripe.

Second Spotlight does not store full payment card details.

Seller payouts may be delayed:

  • pending identity verification
  • during disputes or investigations
  • where fraud or suspicious activity is suspected
  • where required by payment providers or law

7. Shipping and Delivery

Sellers are responsible for:

  • packaging items appropriately
  • dispatching items within a reasonable timeframe
  • providing accurate shipping information

Buyers are responsible for ensuring their delivery address is correct.

Second Spotlight is not responsible for postal delays, courier issues or items lost in transit, although we may assist in dispute resolution where possible.

8. Returns, Refunds and Disputes

As most items sold on Second Spotlight are second-hand goods sold by independent sellers, returns are not automatically accepted unless:

  • required by law
  • the item is significantly not as described
  • the wrong item was sent

Buyers should carefully review listing descriptions and photos before purchasing.

If a dispute arises, users should first attempt to resolve the matter directly through the platform messaging system.

Second Spotlight may assist with dispute resolution at our discretion, but we are not obligated to act as an arbitrator between buyers and sellers.

We reserve the right to:

  • issue refunds
  • withhold payouts
  • remove listings
  • suspend accounts where necessary to protect users or the platform.

9. Marketplace Role

Second Spotlight acts solely as a marketplace platform connecting buyers and sellers.

We are not responsible for:

  • the quality, safety or legality of items
  • the accuracy of listings
  • seller conduct
  • buyer conduct
  • transactions between users

Any contract for the sale of goods is made directly between the buyer and seller.

10. User Content

Users retain ownership of content they upload, including photos and descriptions.

By uploading content to Second Spotlight, you grant us a non-exclusive, worldwide, royalty-free licence to use, display and promote that content in connection with the operation and marketing of the platform.

You confirm that:

  • you own or have permission to use uploaded content
  • your content does not infringe the rights of others

We reserve the right to remove content that breaches these Terms.

11. Prohibited Behaviour

Users must not:

  • provide false information
  • misuse the platform
  • harass or abuse other users
  • attempt to complete transactions outside the platform to avoid fees
  • upload harmful software or malicious content
  • infringe intellectual property rights

12. Intellectual Property

The Second Spotlight platform, branding, logos and website content remain the property of Second Spotlight unless otherwise stated.

Users may not copy, reproduce or use our branding without permission.

13. Limitation of Liability

To the fullest extent permitted by law, Second Spotlight shall not be liable for:

  • indirect or consequential losses
  • loss of profits
  • loss of data
  • disputes between users
  • issues caused by third-party services or payment providers

Nothing in these Terms excludes liability that cannot legally be excluded under UK law.

14. Termination

We reserve the right to suspend or terminate access to the platform at any time where these Terms are breached or where necessary to protect the platform or its users.

15. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on this page with a revised update date.

Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms or the use of the platform shall be subject to the jurisdiction of the courts of England and Wales.
